Pelaksanaan Nikah Ulang (Tajdid Nikah) Di Kantor Urusan Agama (Kua) Kecamatan Bumi Makmur Periode Bulan Juli-Agustus 2025

Abstract

This research is motivated by the phenomenon of nikah ulang or tajdīd an-nikāh (remarriage), which still occurs in society, particularly in Bumi Makmur District, as an effort to obtain legal recognition for marriages previously conducted unofficially (nikah siri) or whose legalization through isbat nikah was rejected by the Religious Court. The purpose of this study is to examine the procedures implemented by the Office of Religious Affairs (KUA) in handling remarriage cases and to identify the factors contributing to this practice. This study employs a qualitative descriptive method with a juridical-empirical approach, utilizing field data collection and interviews with KUA officials in Bumi Makmur. The results show that remarriage procedures at KUA follow the same administrative process as regular marriages, involving document verification and official registration by marriage registrars (PPN). The main factors behind remarriage include unregistered (siri) marriages, invalid guardians (wali nikah), rejection of isbat nikah due to underage marriage, and increased public awareness of the importance of marriage registration. Normatively, this practice aligns with Article 2 of Law Number 1 of 1974 on Marriage, although from a procedural standpoint, isbat nikah remains the more appropriate legal mechanism. This study contributes to a deeper understanding of the importance of marriage registration and provides valuable input for KUA in improving legal services for the Muslim community.
